APPLICATION AND INTERPRETATION
Your customer contract with us (Stylework Productions trading as Photo Booth Fun ABN 92 923 268 192) includes these terms; our request to quote application; and terms and conditions as stated below.
Dictionary Definitions contained in this dictionary apply to this application
“Client / Customer”, “You / Your” means the party described as such on here within and the terms can be used interchangeably.
“Booking/event/service” means, unless the context requires otherwise, goods or services supplied by Photo Booth Fun as part of the services.
“Contact Information” means the contact details, including addresses, telephone numbers, email addresses, or similar of the customer.
“Service” means any service (or combination of services) we agree to provide you as per the booking request.
Prices are subject to change please check before booking. By paying any part of the invoice the client is also agreeing to the Terms & Conditions. A $200 deposit is necessary to secure the event time and date. Until a deposit is received, the date cannot be confirmed. The outstanding amount must be paid by the client to Stylework Productions trading as Photo Booth Fun Booth at least 7 days before the date of the event. If booked within 7 days of the event, non-refundable full payment must be received within 48 hours of booking. A travel surcharge will apply to events 10 kms outside of the Melbourne (CBD)metropolitan area. An idle fee may apply for extensive waiting periods. Certain dates may be subject to an additional surcharge. Funny face props (if used) must be in good order at the end of the event, otherwise a charge may apply.
All prices are exclusive of GST unless otherwise stated.
All deposits are non-refundable . If the client cancels within 30 days before the event date the deposit can be held in lieu for a period of 12 months for a future booking. Prior notice is required of changes to the time and date of the event. Photo Booth Fun cannot be held responsible for unforeseen delays at the venue.
Delivery + travel fees
For events greater than 35km we require a 4 hour minimum hire. Parking in Melbourne CBD will be arranged or paid for by the client.
Hiring, delivery & service
Delivery, set up and removal of the equipment are free of charge. Time taken to deliver, set up and remove the equipment will be outside the hire period. If a booth attendant has been booked he/she will aim to arrive between half an hour to an hour (depending if setup is required) prior to booking time. Earlier setup time can be arranged in discussion with Photo Booth Fun and an idle fee may be applied for setup much earlier than the designated booking time. When a photo booth operator is not present a trained booth technician will be within close proximity of the equipment at all times to ensure smooth running. The customer will be liable for any damage caused to the equipment (Original Photo Booth, Photo Lounge, Motion Booth, Video Booth and/or any accessory associated) within the duration of the booking.
Use of images
When hiring from Photo Booth Fun, the customer gives permission for images taken at the event to be used on the Photo Booth Fun website, social media accounts and for advertising purposes as we see fit. Unless advised prior to the event that they would not like their images used. Photo Booth Fun will not use images which are deemed unsuitable on their website or for advertising and will not use any content that may be personally damaging to any person/s.
Any artwork, design and/or image created, developed or given to us for the purpose of fulfilling the booking for the client, unless otherwise expressly provided in writing shall be owned by Photo Booth Fun and all Intellectual Property rights therein. Artwork, designs and/or images supplied to the client for completion of the booking can not be used, replicated, duplicated, or recreated in any means and all work falls under standard copyright laws.
Any artwork, designs and/or images created or worked on by us outside of the standard templates may incur an artwork fee and shall be charged to the client before the event date.
All or any digital images shall be held for a period no longer than 30 days from the date of service of which all or any images shall be purged. When purchasing digital copies of images either before or after a booking the customer agrees to have these images stored on a selected cloud platform decided by Photo Booth Fun for a period no longer than 14 days. Access will be granted upon full payment only to the customer who placed the order in full for the service. After the 14 day period the customer/s will not have access to digital images via the specified platform.
We will not be liable for failing to perform under the Agreement by the occurrence of any event beyond our reasonable control, including a labour disturbance, internet outage or interruption of service, communication outage failure by a service provided to us to perform, fire, threatened or actual act of terrorism, natural disaster, or war.
Photo Booth Operators & Technicians
When hiring one of our services for a period of 4 or more hours in one booking/event our photo booth operators and/or technicians require set break periods as stated below,
4 – 5 hour booking = 10 minute rest break
More than 5 – less than 7 hour booking = 10 minute rest break and 30 minute meal break
7 – less than 10 hour booking = 2 x 10 minute rest breaks + 45 minute meal break
10 or more hour booking = 2 x 10 minute rest breaks + 2 x 45 minute meal breaks
A photo booth operator or technician who gets 2 rest breaks must take 1 break in the first half of their shift, and the other break in the second half of their shift.
Our staff can’t be asked to:
take a rest or meal break within 1 hour of starting or finishing a booking
take a rest break combined with a meal break
work more than 5 hours without a meal break.
The client hereby agrees to protect, defend, indemnify, and hold harmless Stylework Productions t/a Photo Booth Fun from and against any and all claims, losses, liabilities, settlements, expenses, and damages, including legal fees and costs (all referred to collectively as “Claims”), which Photo Booth Fun may suffer or to which (he/she/it) may be subjected for any reason, even if attributable to negligence on the part of Photo Booth Fun or any other entity, arising out of or related to any act, omission, or occurrence in connection with the creation, production, or use of any image or the performance of any service relating to this Agreement or its subject matter. This provision shall apply to Claims of every sort and nature, whether based on tort, strict liability, personal injury, property damage, contract, defamation, privacy rights, publicity rights, copyrights, or otherwise. The client assumes all risks, and (his/her/its) obligations under this provision shall survive the performance, termination, or cancellation of this Agreement.
